Civil litigation is a necessary part of our judicial system to help resolve non-criminal disputes between two parties. This sort of legal dispute involves compensation, monetary or otherwise, and/or specific performance, for damages incurred, or services not satisfactorily provided. There are several stages to the litigation proceedings, including pleadings, discovery, settlement conferences, and eventually trial. The process allows each respective party the time to investigate and prepare their case and gather appropriate and compelling evidence. Each case is unique and our team will evaluate each case to determine the best strategy for success.
Civil litigation begins with the filing of pleadings. During the pleadings stage, the Plaintiff (party alleging that they have been wronged) will initiate a lawsuit by filing and serving a summons and complaint. Generally, the complaint identifies the party and/or parties who allegedly caused the harm (Defendant(s)), the type of harm that occurred, the date, time and location in which the harm occurred, and the compensation being sought. The Defendant(s) will then file an Answer, which disputes the factual allegations and legal claims made by the Plaintiff, and asserts affirmative defenses against the claim. Failure to timely file an answer will result in a default judgement in favor of the Plaintiff. In lieu of an Answer, defendant(s) may also consider filing a pre-Answer motions to dismiss. As long as the matter is not dismissed, the case will then proceed into the discovery stage. The majority of cases will settle, but if there is no settlement, the case will be submitted to a jury trial.
